Court won’t delay Ohio execution
OHIO — A federal appeals court in Cincinnati will not delay the execution of condemned killer Kenneth Biros, who today is scheduled to become the first person in the U.S. put to death with a single drug.
The 6th U.S. Circuit Court of Appeals on Monday night declined Biros’ request for a stay. Earlier in the day, a federal judge had also declined to delay the execution. Biros, 51, has said the state has failed to fix the problems that led to an unsuccessful execution attempt in September.
